Terms of Service

Welcome to Radio Javan. These Terms of Service (the "Terms") govern your use of Radio Javan websites, mobile apps, subscriptions, events, uploads, artist tools, communications, and other products or services that link to these Terms (collectively, the "Service"). "RJ," "we," "us," and "our" mean Radio Javan, Inc. and its affiliates, as applicable.

By using the Service, creating an account, buying a subscription or ticket, submitting content, joining an artist team, or using any feature that links to these Terms, you agree to these Terms. If you do not agree, please do not use the Service.

1. PRIVACY

Our Privacy Policy explains how we collect, use, share, and protect information. By using the Service, you acknowledge that your information will be handled as described in the Privacy Policy.

2. CHANGES TO THESE TERMS OR THE SERVICE

We may update these Terms from time to time by posting a revised version on this page and updating the "Last updated" date. The updated Terms apply to your continued use of the Service after they are posted. If a change is material, we may provide additional notice as appropriate.

We may add, change, suspend, or discontinue features, content, subscriptions, offers, apps, tools, or parts of the Service at any time. We may also limit availability by location, device, account type, subscription status, rights restrictions, technical requirements, or other reasons.

3. THE SERVICE

The Service includes music, videos, playlists, recommendations, search, comments, profiles, events, subscriptions, artist tools, upload and release tools, communications, and related features. Some features may require an account, a subscription, a supported device, a supported app version, or additional information from you.

Some features may be offered as beta, preview, experimental, limited-release, or test features. Those features may be changed, limited, suspended, or removed at any time and may not always work as expected.

The Service may include links or access to third-party websites, app stores, payment processors, platforms, devices, services, or content that we do not control. We are not responsible for those third parties, and your use of them may be governed by their own terms and policies.

4. ACCOUNTS AND SECURITY

You may need an account to use some parts of the Service. You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for keeping your login credentials secure and for activity that happens through your account.

You may not use another person's account without permission, impersonate another person, create an account using false information, or create accounts to evade enforcement. Please notify us if you believe your account has been compromised.

If you use artist tools, team features, upload tools, release tools, or similar account-based features on behalf of an artist, label, manager, rights holder, organization, or other person, you confirm that you have authority to do so. You are responsible for the information, content, permissions, team members, and activity connected with that access.

You can request account deletion from your Profile page or by contacting us at [email protected]. Account deletion may begin with a deactivation period so you can restore your account for a limited time. We may retain certain information where allowed or required by law, including for security, fraud prevention, legal compliance, accounting, dispute resolution, rights management, or service integrity.

5. SUBSCRIPTIONS, PURCHASES, AND OFFERS

Some parts of the Service require payment, such as subscriptions, tickets, offers, or other paid features. Prices, plans, features, trials, promotions, billing periods, and availability may change from time to time. Taxes, fees, or carrier charges may apply.

If you purchase a subscription, it may automatically renew unless you cancel before the end of the current billing period. You can cancel subscriptions purchased directly from RJ through your Profile page. Subscriptions purchased through the Apple App Store, Google Play Store, or another third-party platform must be managed through that platform's subscription settings and are subject to that platform's billing and refund rules.

Unless required by law or stated otherwise at the time of purchase, payments are non-refundable and we do not provide refunds, credits, or prorated refunds for partial billing periods, unused features, deleted accounts, or content that becomes unavailable. We may refuse, cancel, or limit purchases, offers, trials, or promotions if we believe there is fraud, abuse, error, misuse, or a violation of these Terms.

6. YOUR USE OF THE SERVICE

You may use the Service for personal, non-commercial use unless we give you written permission or a feature expressly allows another use. You may not copy, sell, rent, license, redistribute, frame, scrape, or exploit the Service or any content available through it except as allowed by these Terms, by law, or by functionality we provide.

You agree not to misuse the Service. For example, you may not:

violate any law, contract, third-party right, or RJ policy;
infringe or misuse copyrights, trademarks, privacy rights, publicity rights, music rights, publishing rights, or other rights;
post or submit content that is illegal, deceptive, defamatory, hateful, harassing, threatening, exploitative, sexually explicit, spammy, or harmful to minors;
impersonate anyone, misrepresent your identity or authority, or falsely imply an affiliation with RJ or another person;
upload malware, attempt to bypass security, disrupt the Service, probe systems, or gain unauthorized access;
scrape, crawl, harvest, mine, copy, or use automated systems to access the Service or collect data except as expressly allowed by RJ;
manipulate plays, likes, follows, ratings, rankings, recommendations, promotions, contests, reporting, or other signals;
use the Service to send unauthorized advertising, spam, scams, phishing, or other unwanted communications;
use the Service in a way that interferes with anyone else's use or creates risk for users, artists, partners, RJ, or the Service.

7. USER CONTENT AND SUBMISSIONS

The Service may let you submit, upload, publish, share, or make available content, including comments, playlists, profile information, artist information, music submissions, audio, artwork, videos, photos, lyrics, credits, release details, metadata, messages, feedback, and other files or text ("User Content"). You keep ownership of your User Content, but you are responsible for it.

By submitting User Content, you grant RJ a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, transmit, stream, publicly perform, publicly display, publish, translate, modify, adapt, format, transcode, create excerpts or previews from, promote, and otherwise use that User Content as needed to operate, provide, improve, market, and protect the Service.

For User Content submitted for artist, upload, release, lyrics, credits, artwork, video, or similar review, you grant RJ the rights needed to review, process, verify, format, publish, reject, remove, promote, distribute, and maintain records related to that content. We do not promise that any submission will be accepted, published, promoted, kept available, or generate any particular result.

You represent and warrant that you own or have all rights, permissions, licenses, clearances, and consents needed for your User Content and for RJ to use it as described in these Terms. This includes rights in sound recordings, musical compositions, samples, artwork, videos, images, names, likenesses, voices, trademarks, credits, metadata, privacy rights, publicity rights, and any third-party material included in your User Content.

You also agree that your User Content and your use of the Service will not violate law, infringe rights, contain false or misleading information, or require RJ to pay anyone unless RJ has separately agreed in writing. You are responsible for disputes, claims, royalties, payments, reporting, consents, or obligations related to your User Content, except where RJ has expressly agreed otherwise.

Some User Content may be visible to other users or the public. Please do not include private information in public content unless you want it to be public. If you remove User Content or delete your account, some copies or references may remain where permitted by law or reasonably needed for backups, records, safety, rights management, already-shared content, or continued operation of the Service.

8. MODERATION AND ENFORCEMENT

We may review, moderate, reject, remove, restrict, label, disable, or refuse to distribute content or accounts at any time if we believe it may violate these Terms, violate law, create risk, harm the Service, harm users, or conflict with RJ's editorial, technical, business, or safety judgment.

We may suspend, restrict, or terminate access to the Service, subscriptions, accounts, artist tools, uploads, or content at any time if we believe there is a violation, abuse, fraud, security issue, rights issue, nonpayment, legal risk, or other risk to RJ, users, artists, partners, or the Service. We may also preserve information and cooperate with law enforcement or rights holders where appropriate.

If you see content or activity that you believe violates these Terms or infringes your rights, please use available reporting tools or contact us. We may not respond to every report, and we decide what action is appropriate in our discretion.

9. RJ CONTENT AND INTELLECTUAL PROPERTY

The Service, including software, design, text, graphics, logos, interfaces, features, compilations, data, and RJ-created content, is owned by RJ or its licensors and is protected by copyright, trademark, and other laws. Except for rights expressly granted to you, RJ and its licensors reserve all rights in the Service and RJ content.

Radio Javan, RJTV, RJ, and related names, logos, and marks are trademarks or service marks of RJ or its licensors. You may not use RJ marks in a way that suggests sponsorship, endorsement, affiliation, or approval without our prior written permission.

RJ respects intellectual property rights and may terminate repeat infringers where appropriate. If you believe content on the Service infringes your copyright, you may submit a notice through our copyright form or contact:

Your notice should include enough information for us to identify the copyrighted work, the allegedly infringing material, your contact information, your signature, and the statements required by the Digital Millennium Copyright Act. Misrepresentations in a notice or counter-notice may create liability.

10. APP STORES, DEVICES, AND THIRD-PARTY SERVICES

When you download or use an RJ app through Apple, Google, or another third-party platform we support, your use may also be governed by that third party's terms, policies, billing rules, device requirements, and refund rules. Those third parties are not responsible for the Service unless their own terms say otherwise.

Carrier data, messaging, roaming, device, and internet fees may apply. We do not guarantee that the Service will work on every device, operating system, browser, network, country, or app version.

11. RECOMMENDATIONS, SEARCH, AND AUTOMATED TOOLS

The Service may include recommendations, search results, playlists, rankings, classifications, prompts, generated text, summaries, quality checks, safety checks, and other automated or assisted tools. These features may rely on account activity, content, metadata, location signals, device signals, and other information described in our Privacy Policy.

Automated tools can be imperfect. Results may be incomplete, inaccurate, offensive, unavailable, or not suitable for your intended use. You are responsible for reviewing and deciding whether to rely on or use any output, suggestion, recommendation, or result.

12. PROMOTIONS AND DISCLOSURES

If you receive payment, free items, discounts, access, or another benefit from RJ or anyone else in connection with content you post or share, you are responsible for making any disclosures required by law or platform rules. Promotions, contests, sweepstakes, or special offers may have additional rules shown with the promotion.

13. AGE REQUIREMENTS

The Service is not intended for children under 13. By using the Service, you confirm that you are at least 13 years old. If you are under the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian who agrees to these Terms.

14. DISCLAIMERS

To the maximum extent permitted by law, the Service is provided "as is" and "as available." RJ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and error-free operation.

RJ does not guarantee that content, recommendations, search results, uploads, releases, subscriptions, events, reporting, messages, or other features will be accurate, complete, uninterrupted, secure, available, or suitable for your needs. Content may change, become unavailable, or be removed because of rights, business, technical, legal, safety, or other reasons.

RJ is not responsible for products, services, websites, apps, content, offers, or conduct of third parties, even if they are linked from or integrated with the Service.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, RJ and its affiliates, licensors, service providers, business partners, officers, directors, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, device issues, content loss, or unauthorized access, even if we have been advised that such damages may occur.

To the maximum extent permitted by law, RJ's total liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of the amount you paid directly to RJ for the Service giving rise to the claim during the three months before the event giving rise to liability or one hundred dollars (US $100).

16. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless RJ and its affiliates, licensors, service providers, business partners, officers, directors, employees, contractors, and agents from and against claims, demands, investigations, losses, liabilities, damages, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your account, your User Content, your submissions, your violation of these Terms, your violation of law, your violation of third-party rights, or any dispute between you and another person or organization.

17. GOVERNING LAW AND DISPUTES

These Terms and all matters relating to the Service will be governed by the laws of the United States and the laws of the State of Virginia, without regard to conflicts of laws rules. You agree to the personal jurisdiction and venue of the state and federal courts located in Arlington County, Virginia, and waive any objection to that jurisdiction or venue.

Any claim arising out of or related to these Terms or the Service must be brought within one year after the claim arises, unless a longer period is required by law.

18. GENERAL TERMS

These Terms, together with the Privacy Policy and any additional terms that apply to a feature, make up the agreement between you and RJ for the Service. If additional terms apply to a specific feature, those terms control for that feature if they conflict with these Terms.

You may not assign or transfer these Terms without RJ's prior written permission. RJ may assign or transfer these Terms, in whole or in part, to an affiliate, successor, service provider, or other person or entity as part of operating, improving, or transferring the Service.

If any part of these Terms is found invalid or unenforceable, the rest will remain in effect, and the invalid or unenforceable part will be interpreted as closely as possible to the original intent in a lawful way. If RJ does not enforce a provision right away, that does not mean RJ has waived the right to enforce it later. Sections that by their nature should survive will continue after your account, access, or these Terms end.
